Coronavirus: Amid Heavy Demand Miami-Dade Resumes Film Permits

Miami-Dade resumes film permits following the Coronavirus COVID-19 related shutdown.

According to Miami Today News, the Miami-Dade County Office of Film & Entertainment is resuming issue film permits, but on a limited case-by-case basis. The approval process of obtaining a permit for location filming could take longer than usual, with possible shooting dates set for mid-June.

Depending on how much space is needed. Also, if health and safety staff are available, production crews will be allowed to shoot at government buildings, said Sandy Lighterman, Miami-Dade’s Film and Entertainment commissioner.

Meanwhile, beaches, parks, Florida courts, and correctional facility filming or photo permits are not issued.

“There have been a lot of healthy discussions involving local, national, and international level organizations in regards to coming back. Unions, production companies, and studios are coming up with even stricter guidelines for everyone’s safety with the help from CDC medical officials,” Ms. Lighterman said.

The county’s film and entertainment office currently give permits for 13 municipalities across Miami-Dade, which are abiding by the health and safety Coronavirus guidelines. These guidelines have stricter regulations going beyond the county’s current safety regulations.

“The film industry touches so many aspects of businesses, like hair and makeup artists, talent, directors, and production crews. That is why we want to do it the right way and take care of our film industry, making sure everyone goes home safely,” Ms. Lighterman said.

Filming in Miami-Dade adds revenue to the county’s economy. Florida’s Department of Economic Opportunity found that over seven years approximately 300 film productions received state tax credits spent $1.26 billion in the state, paid $751 million in wages and created over 100,000 jobs.

Due to the safety guidelines, new ways of content is created. Due to guidelines that will have fewer crew members and have shorter days. Ms. Lighterman said, “There is going to be a lot of pre-production planning ahead of time, which is key. Once on set there will not be much to worry about.”

“The film & entertainment industry is economic development and we want to put crews back to work, but in a safe manner,” Ms. Lighterman said. “It’s definitely a puzzle, but I’m sure we will figure it out.”

In related news, after the Coronavirus pandemic shutdown of all filming productions across the UK, movies such as The Batman are allowed to continue filming.

The British Film Commission and the British Film Institute came together to create a list of guidelines that the Department for Culture, Media and Sport (DCMS), Public Health England and the Health and Safety Executive, meaning the United Kingdom film and TV production can start filming.

Georgia Requires Audits for Movie and TV Film Tax Credits

Georgia’s film industry implements major changes to their film tax credits

(Updated August 5, 2020) Last week, Gov. Brian Kemp approved changes to the Georgia Entertainment Industry Investment Incentive Act, which requires mandatory audits by production companies before applying for the 30% film tax credit. The amendment to the Georgia law will reportedly “streamline the process of applying for film and television tax credits in the state as officials said current rules have been outstripped by the explosion production the state over the past decade.”

Regulators are currently working on a set of codified rules and regulations with the plan of making the application process easier and faster. In addition, Georgia will provide a list of approved auditors and creating a timeline when tax credits will be transferred. Deadline reports, productions do not use the tax credits. Instead, they sell them to brokers.

Steve Weizenecker, Vice-Chair of Kemp’s Advisory Commission on Film, Music and Digital Entertainment, told Deadline the changes have been in the works for over a year and are meant to “increase integrity in the program by introducing an audit process so that there is no questions about the tax credit.”

He added that this is a “win-win” for the film industry since “they know what the rules of the road are and how their credits will be reviewed.”

It was necessary as the state saw a dramatic rise in production to a $10 billion business. The large size caused increase scrutiny and necessary accountability.

Georgia Film Office director Lee Thomas told Deadline the update is “a sensible, phased approach to audits for companies seeking tax credit for film or television productions in Georgia.”

She added it was supported by multiple government agencies including the Governor’s office, the Georgia Department of Revenue, the film industry, the Georgia Film Office, and the Georgia General Assembly.

How will the new film tax credit process work?

A production finishes filming, usually after a month it’ done, the company will hire an approved auditor to review the accounting and issue a certificate. Producers and auditors will work off of guidelines on what qualifies and what does not apply.

Regulators will soon release guidelines so the new changes go into effect by January 2021.

Starting 2021, audits will be limited to productions seeking a film tax credit for more than $2.5 million. In 2022, the requirement, will then apply to productions claiming more than $1.25 million in tax credits, and 2023, it will apply to all productions in the state.

In addition, tax credits cannot be transferred until the audit is completed. At this time, tax credits can be transferred any time and going forward, credits will last for three years from the date the audit completed. Currently, they are good for five ears.

“It’s a great law. They did a really, really smart thing. There is nothing negative, it is all just positive cleanup,” Ryan Millsap told Deadline, CEO of Blackhall Studios, a large production studio in Atlanta. “They basically mandate that when you make a movie in Georgia, the whole movie accounting process has to be audited. It means no fraud, and that the program will last a long, long time.”

Film companies that apply for Georgia’s film tax credit could face new scrutiny.

(Update June 27, 2020) House Bill 1037, sponsored by Rep. Matt Dollar, R-Marietta, requires all productions located in Georgia to undergo mandatory audits by the Georgia Department of Revenue or third-party auditors chosen by the state. It will also place additional restrictions on how film companies could transfer or sell unused tax credits to other businesses.

The Georgia Senate passed the measure by a 45-1 vote, with the state House of Representatives following suit on Friday by a 154-10 vote. Gov. Brian Kemp will have to sign the bill for it to become enforceable.

“This is full auditing of all the film tax credits,” Senate Finance Committee Chairman Chuck Hufstetler, R-Rome said Thursday. “Nothing more, nothing less.”

On the bright side for Georgia’s film industry, there is reportedly no movement on HB 1035 bill, which would cut Georgia’s Film Tax Credit and all tax breaks by 10%.

Georgia Film Tax Credit could get capped as Senators consider budget cuts.

(Update June 22, 2020) Georgia, the previous filmmaking capital of the world, is getting ready to resume production. However, several Georgia Senators are considering cutting the state’s film tax credit.

The Georgia film tax credit is arguably the world’s most generous filming incentive in the entertainment industry. However, the future of the state’s film industry is on the verge of getting cut following a never before seen budget crisis.

On Juneteenth, the state Senate passed $2.6 billion in budget cuts, including $1 billion to K-12 education. As a result, the state’s film tax credit, which spent $860 million last year, could be on the verge of getting cut.

“I think there is a political will to cap it,” said Rep. Matt Dollar, who chairs the House Working Group on Creative Arts and Entertainment said. “It’s been talked about since the session started.”

On Monday, the Senate Finance Committee approved a bill, HB 1037, that would mandate audits for all film and TV projects that receive the film tax credit. The bill came after a state audit issued last January found potential issues in the program.

The bill also included verbiage which could expand the size of the credit by allowing commercials and other “presentations” to qualify. However. Sen. Chuck Hufstetler, the committee chairman, cut the language out, saying he was not comfortable expanding the film tax credit.

“I really wasn’t interested in pursuing that bill with — it could be millions more,” Hufstetler said.

Georgia 2020 Film Tax Credit Audit

In January, the Georgia Department of Audits and Accounts suggested the legislature to consider capping the film tax credit, to limit the potential risk the film tax credit caused the state.

A Georgia state audit found the lack of oversight into Georgia’s tax credit for movie and TV productions filming makes the film tax credit a conducive environment for fraud.

Georgia’s film tax credit is popular among those working in the film industry but, it comes with a major cost, according to the AJC report. The tax credit had grown from $141 million in 2010 to an estimated $870 million in 2019.

Companies received film tax credits they did not qualify, auditors claim. According to auditors, millions of dollars in inappropriate expenses by film businesses, including wages to workers or contractors for work companies completed outside Georgia.

“The impact of the film tax credit on the state’s economy has been significantly overstated, leaving decision-makers without accurate information necessary to assess the credit,” the State Georgia Film Tax Credit audit report says.

The audit also claims the film industry produced 29,006 jobs but, the film tax credits also cost the state 19,876 jobs due to decreased government spending, leaving a net creation of jobs at 9,130.

Georgia Budget Hearing

(Original post: June 1, 2020) Georgia’s film tax credit reportedly came up for discussion during a legislative hearing on making budget cuts once the 2020 Georgia General Assembly resumes their session next month.

Pat Wilson, the commissioner of the Georgia Department of Economic Development, told members of a state Senate Appropriations subcommittee that Georgia’s growing film industry generated approximately $8.5 billion in economic impact, including $2.9 billion in direct spending. Nearly 90,000 Georgians were employed in film and TV productions before the coronavirus pandemic shut down the industry, Wilson added.

However, the Georgia tax credit also costs taxpayers about $400 million per year. As Gov. Brian Kemp and other legislative leaders looking to reduce spending even before the Coronavirus Pandemic, the cost of the tax credit caused two audits of the film industry last January. Those audits helped spark the introduction of legislation to implement stricter rules on the transfer or sale of unused credits, which is used by production groups that film part of the movie outside of Georgia.

Senator Jen Jordan, D-Atlanta, a member of the subcommittee, says the prohibition of the sale of tax credits may convince more studios to film their entire production in Georgia.

“The studios that are writing the checks and paying the money are in Los Angeles,” he said. “A lot of them are moving operations here. That doesn’t mean they’re going to leave the talent base they have in California.”

Wilson explained how the economic development agency plans to prioritize operations while cutting their budget by nearly $5 million to meet 14% spending reductions state agencies are being required to offer substantial loss of tax revenue resulting from the Coronavirus lockdown.

The department’s marketing activities and tourism will receive the most significant cuts instead of payroll.

“We have a great pipeline [of potential projects] in practically every division,” he said. “We decided to keep personnel so we could work the pipeline we have now.”

“The long-term impact will be significant if we don’t come back with marketing,” he said. “We are going to have to grow back.”

Coronavirus: ‘The Batman’ and ‘Fantastic Beasts 3’ are Allowed to Resume Filming in the UK

After the Coronavirus pandemic shutdown of all filming productions across the UK, movies such as The Batman are allowed to continue filming.

These new guidelines allow for productions to start filming if each episode costs more than £1m GBP (approx. $1.24m USD). Self-employed freelance film and TV workers will also be allowed to return back to work after the new guidelines.

According to Screenrant, these guidelines including training, physical social distancing, and temperature checks. While the rule has been passed in the UnitedKingdom, it is still up to productions to decide if they are going to film. Warner Bros.’ ‘The Batman’ and ‘Fantastic Beasts 3’ is still taking precautions and will start safely filming as soon as possible.

Robert Pattinson’s ‘The Batman’ was set to release on June 25, 2021, but is now expected to hit theaters on October 1, 2021.

Netflix, HBO, HULU and More Support Black Lives Matter Movement During George Floyd Protests

Amid George Floyd protests against police brutality take place across the country, entertainment companies issue statements of support for the Black Lives Matter movement.

Netflix, Amazon, Hulu, HBO, Starz, and other major Hollywood influencers used their social media platforms to take a stand and support the Black Lives Matter movement during widespread protests against the death of George Floyd due to police officers.

Netflix tweeted: “To be silent is to be complicit. Black lives matter. We have a platform, and we have a duty to our Black members, employees, creators, and talent to speak up.”

According to Variety, CEO of ViacomCBS Jim Gianopulos sent a memo to employees, saying “Too many members of the Black community have had their breath stolen from them through racial injustice.”

The decision to use their platform to support the Black Lives Matter movement has gone viral and gained support from other Hollywood celebrities including director Ava DuVernay and Netflix star Uzo Aduba.

Meanwhile, YouTube posted on Friday that “We stand in solidarity against racism and violence. When members of our community hurt, we all hurt. We’re pledging $1M in support of efforts to address social injustice.”

Several other entertainment companies followed in Netflix’s footsteps on Saturday night. Disney-owned Hulu tweeted and posted on Instagram, “We support Black lives. Today, and every day. You are seen. You are heard. And we are with you.”

Other WarnerMedia brands tweeted their support. HBO, HBO Max, TBS, TNT changed their Twitter handles to #BlackLivesMatter and posted, “Neither love nor terror makes one blind: indifference makes one blind.” — James Baldwin”

Amazon Studios posted on Twitter and Instagram “Together we stand with the Black community — colleagues, artists, writers, storytellers, producers, our viewers — and all allies in the fight against racism and injustice.”

Starz also supported the Black Lives Matter movement saying, “We cannot stand silent while our Black communities under the weight of violence, discrimination and injustice,” wrote Starz on Twitter and Instagram. “Color of Change and the NAACP are among the organizations taking the lead in the fight for racial justice in America. We support them in their mission and you can too.”

TikTok even issued a statement: “At TikTok we deeply value the diverse voices among our users, creators, artists, partners, and employees. We stand with the Black community and are proud to provide a platform where #blacklivesmatter and #georgefloyd generate powerful and important content with over 1 billion views. We are committed to fostering a space where everyone is seen and heard.”

Twitch also posted a similar statement. “Black people have been suffering under the oppressive weight of racism in America for far too long. We cannot delight in the creative contributions of the Black community on Twitch and remain silent while they are in pain. We’re asking you to come together to and stand up for Black lives whether it’s through your time, treasure, or talent. Don’t let today’s injustice stop us from creating a better tomorrow for our community.”

In relevant news, following the death of George Floyd, a video with Denzel Washington helping a man with a police encounter is going viral and fans are calling the actor a real-life superhero.

On May 22, TMZ reported Washington stopped and helped a homeless man who was “in some peril with oncoming traffic.”

Video footage of the incident shows Denzel Washington comforting the man and waiting with the man during an encounter with police.

TMZ reported the man was “detained — not sure why but possibly to make sure he was okay — then released.”

Superman: Henry Cavill in Talks to Return to His Superman Role

Actor Henry Cavill is reprising his role as Superman with Warner Bros and DC Comics.

The actor initially left the franchise in 2018 due to a scheduling conflict for his role in “Shazam!”, but a report from Comic Book suggests a new deal has led the actor to return to the franchise. According to reports, the transaction is why Cavill appeared on Zack Snyder’s live stream of “Man of Steel” last week, which ended with the announcement of the “Justice League” director’s cut is heading to HBO Max. The actor is set to reprise his role of Superman with Warner Bros. planning on putting the characters in movies based on other superheroes, taking more cameo roles instead of lead roles similar to The Hulk in the Marvel Cinematic Universe. As a result, there are no plans to move forward with a “Man of Steel” franchise film.

This news comes after reports surfaced Michael B. Jordan was asked to play Superman in future films. Variety reports Jordan and the mega-studio spoke earlier this year about his vision for the caped-crusader. However, Jordan left the meeting unlikely to take the role due to Warner Bros’ commitment to the superhero character. According to reports, filming does not seem likely to start for several years, and there is no script or director. Also, Michael B. Jordan is extremely busy with a packed schedule for the next several years.

In relevant news, Henry Cavill shared acting advice for aspiring actors. In 2017, the actor told ITV News that any aspiring actor should “work hard and study hard,” take tips from previous great movies and “learn about storytelling.”

Video with Denzel Washington and Police Goes Viral After George Floyd’s Death

Following the death of George Floyd, a video with Denzel Washington helping a man with a police encounter is going viral and fans are calling the actor a real-life superhero.

On May 22, TMZ reported Washington stopped and helped a homeless man who was “in some peril with oncoming traffic.”

Video footage of the incident shows Denzel Washington comforting the man and waiting with the man during an encounter with police.

TMZ reported the man was “detained — not sure why but possibly to make sure he was okay — then released.”

Denzel Washington started trending on Twitter, during a time when interactions between police and Black men have become the topic of conversation across America. In fact, protests against police violence have taken place around the country this week, following the death of George Floyd, who died May 25 in police custody after a White police officer forcibly placed knee on the neck George Floyd for over seven minutes in Minneapolis. The officers claim Floyd was resisting arrest, however, newly releases surveillance video footage witness claim otherwise. 

One Twitter user wrote, This incident with Denzel interceding for the homeless man, just breaks my damn heart. Denzel out there in an old T-shirt, doing the good work. Maybe saving a life. Being a good example for all of us. Thank you, #DenzelWashington.”

In relevant news, surveillance video leading up to George Floy’d arrest does not support police claims George Floyd resisted arrest. According to CNN, surveillance video from outside a Minneapolis restaurant appears to contract police claims that George Floyd resisted arrest before an officer knelt on his neck.

Floyd’s death this week has led to protests against police brutality across the country. All four officers involved in the incident have been fired from the Minneapolis Police Department. But many are calling for the police officers to face criminal charges.

‘Sonic the Hedgehog’ Sequel is Coming Soon

Sonic the Hedgehog‘ sequel is coming soon.

According to VarietyParamount Pictures, and Sega confirmed on Thursday they have started development on a sequel to the live-action family film. The movie will bring back the original filmmakers including Jeff Fowler directing, and Pat Casey and Josh Miller writing the script. The movie is in development so news about casting has not started yet.

The movie is based on the popular video game franchise from Sega. The first movie was released in February 2020 and centers around the world’s fastest hedgehog as he gets used to living on planet Earth.

Sonic (voiced by Ben Schwartz) and his new best friend Tom (played by James Marsden) partner to protect the planet from the diabolical mastermind Dr. Robotnik (played by Jim Carrey) as he plots world control. The family-friendly pic also features Tika Sumpter.’

“Sonic the Hedgehog” landing the No.1 opening weekend all-time for a movie based on a video game and had the fourth-best Presidents Day weekend debut.

John David Washington on Why He Became an Actor, and Not Telling His Dad Denzel Washington

John David Washington did not get help from his A-list star Dad, Denzel Washington, to get into the film industry.

According to reports, John David Washington kept his aspirations a secret from his father until he was cast in his first role.

The “Tenet” actor, 35, revealed in an Esquire interview, he decided to move from football to acting and only told his mother, Pauletta Washington, he was auditioning. He landed his first role on HBO’s “Ballers”.

“There was disbelief,” John David told the magazine of his dad’s reaction. He “kept asking questions like ‘For HBO? Like Home Box Office Entertainment? Who? Really? But what’s it called? The Rock?’ He just kept asking questions like ‘Is this real?’ I guess he had to check it with his agents to make sure it was real, and he was happy for me, and then he said exactly what I was going to do anyway, but ‘As soon as this is over, you gotta go learn. You gotta go learn how to do this.'”

John David Washington tore his Achilles in 2013 and knew his football days were over. He had worked on the practice team for the St. Louis Rams and played for NFL Europe. While recovering from surgery and unsure what to do next, that’s when he got a call from a family friend Andrew Finkelstein, said the casting director Shelia Jaffe was now casting principal roles for an HBO show about professional football players.

“Now, granted, I’m on a heavy medication,” Washington recalled. “I’m feeling very, very loosey-goosey, if you will. I don’t feel the most confident. I’m pretty flammable at this point. I just felt very exposed. And he sends the script and I read it, and I’m like, well, ‘This is cool.'”

David Washington decided if he was going to become an actor, he was going to respect the profession and start by studying the art of acting. Finkelstein decided to set up an audition, saying it would help him get used to the constant rejection that comes from acting, and then sign the actor up for acting classes.

After several auditions, he landed the role of Ricky Jerret on “Ballers”. It was not until after landing the part he told his dad.

John David Washington started taking acting classes at HB Studio. He explained that he took beginner classes got help from a family friend, veteran actor Stephen McKinley Henderson. Henderson told Esquire Denzel wanted to know his son’s progress.

“‘Well, how’s it going, man? How’s it going? Does the guy got any chops? … I don’t want to encourage him if he. .'” Henderson recalled Denzel asking. “I said, ‘Well, man, I’ve got to tell you, he’s got some chops. He does. He definitely does.’ John David understood acting is not so much pretending as really doing and really being there with the other person. When he got it philosophically, he was off to the races. That was it. He was off to the races.”

John David has landed other major acting roles, including in Spike Lee’s 2018 movie “BlackKklansman” and he earned Golden Globe and Screen Actos Guild Award nominations. He currently stars opposite Robert Pattinson in Christopher Nolan’s upcoming major feature film “Tenet”.
