This pivotal move marks the second instance where VFX professionals have united to advocate for equal safeguards and privileges like their peers. In a recent development earlier this month, VFX teams at Marvel Studios decided to unionize, with the process set to commence on August 21. Marvel VFX Artists to Vote for Unionization

The VFX teams at Marvel Studios are embarking on a significant step towards unionization, with the voting process set to commence on August 21. The voting ballots are scheduled to be submitted by September 11, and the final vote count is slated for September 12.

An official press release issued on August 7 highlighted that a “supermajority” of the expansive crew, comprising over 50 workers, had formally endorsed their intent to seek representation from the International Alliance of Theatrical Stage Employees (IATSE).

Mark Patch, the VFX organizer for IATSE, stated, “For nearly five decades, visual effects industry professionals have been devoid of the same safeguards and advantages enjoyed by their peers and colleagues since the inception of the Hollywood film sector. This marks a momentous initial stride as VFX personnel unite to assert their collective voice, advocating for due recognition of our contributions.”

This push for unionization is groundbreaking as it symbolizes the first instance of VFX specialists uniting in this manner, given that this sphere of the industry has primarily existed outside the realm of organized labor. While IATSE currently represents over 168,000 technicians, artisans, and craftspeople engaged in film and television, the kingdom of VFX professionals has historically remained outside its purview. Notably, roles such as production designers/art directors, camera operators, sound technicians, editors, makeup artists, costume designers, script supervisors, grips, lighting experts, and others have traditionally found representation under IATSE, unlike VFX roles.

VFX coordinator Bella Huffman underscored, “The customary rules of turnaround times, safeguarded working hours, and pay parity have yet to encompass our domain. The field of visual effects must evolve into a sustainable and secure realm, catering to the well-being of those who have endured undue hardship and aspiring newcomers seeking an exploitation-free environment.”

This decision by VFX artists is concurrent with a broader surge of union-driven actions within the entertainment industry this summer. Writers and actors simultaneously participate in a historic dual strike, collectively mobilizing for their rights.

Matthew D. Loeb, the International President of IATSE, commented on the timing of the vote amidst this more significant movement, stating, “We are witnessing an unparalleled wave of unity that’s dismantling traditional barriers in the industry, underscoring our shared struggle. This interconnectedness doesn’t occur in isolation. Entertainment professionals worldwide are standing up for each other’s rights; that’s the essence of our movement. I congratulate these professionals for taking this pivotal step and amplifying their collective voice.”

In recent months, Marvel’s VFX artists have garnered significant attention due to the critical reception of their work on current cinematic and television projects, including “Ant-Man and the Wasp: Quantumania,” “Thor: Love and Thunder,” “She-Hulk: Attorney at Law,” and “Secret Invasion.” Concurrently, many exposés have highlighted unfavorable working conditions for VFX artists engaged in Marvel productions. Across various online platforms, these professionals have voiced concerns about the studio’s demanding post-production schedules, ranging from excessive overtime demands to chronic understaffing and the challenge of delivering quality work amid shifting deadlines.

Vulture initially reported the upcoming vote, revealing that workers had expressed a desire for the union election to be held as early as August 21.

WGA’s Response to Studios Suggests A Longer Strike Moving Forward

In response to the recent proposal by the Alliance of Motion Picture and Television Producers (AMPTP), the Writers Guild of America (WGA) stated on Tuesday. Significant hurdles remain despite hopes for a swift resolution to the ongoing 106-day strike.

According to sources familiar with the negotiations, the WGA showed some flexibility on specific points. However, the concessions made by the union’s negotiators needed to meet the substantial demands that the studios were anticipating in response to their proposal.

While the WGA did slightly adjust its stance on the minimum staff size for TV writers, offering a reduction of just one writer, the AMPTP’s counteroffer to grant showrunners the authority to hire a specified minimum number of writers based on the production budget failed to impress the WGA.

Nonetheless, the disagreement extends beyond these specific issues. Both sides remain in contention on various matters, including streaming residuals and an elevated minimum tier for TV writer-producers.

Initial optimism among several studio insiders surrounding the AMPTP’s revised offer was kept from WGA negotiators. They urged caution among members, advising them not to rely on studio leaks suggesting that a resolution was imminent.

Last Friday marked the return of both parties to the negotiation table since the strike’s commencement on May 2.

Notably, the strike’s resolution has garnered personal attention from prominent industry figures. Netflix co-CEO Ted Sarandos and Disney CEO Bob Iger have been actively involved in seeking an end to the dispute.

A central issue for the WGA is including streaming residuals tied to a show’s popularity. Streaming platforms have consistently resisted sharing viewership data, but AMPTP’s recent offer introduces a concept of sharing the number of hours each display is viewed. However, this offer doesn’t tether writers’ compensation to this metric. The WGA, meanwhile, maintains its original proposal, raising concerns about whether “hours” accurately reflect the appropriate measure, as opposed to views.

It was widely anticipated that the WGA would wait to accept the AMPTP’s latest proposal immediately. It is understood that intensive negotiations are still required before a comprehensive agreement can be reached. The studios, however, had hoped for a more substantial alignment between the two sides.

The WGA also pursues a provision allowing its members to respect other unions’ picket lines. This stipulation could delay many writers’ return to work until the resolution of the SAG-AFTRA strike, as both unions have emphasized their shared solidarity.

The AMPTP seems resistant to embracing this proposal, which was initially introduced on August 4th.

Furthermore, the WGA seeks assurances that the union’s health plan will maintain its funding throughout the strike. Ensuring members keep health coverage due to the ongoing labor action remains a priority.

While the AMPTP has offered showrunners the flexibility to hire writers according to the show’s budget, the WGA remains steadfast in pursuing a universal minimum staff size for all performances.

This disparity in approach is not the sole point of contention; various other issues contribute to the ongoing standoff. However, the minimum staff size proposal is a critical obstacle to achieving a resolution.

Within the WGA, there have been internal debates regarding this proposal. Privately, some showrunners expressed concerns, believing this issue isn’t worth prolonging the strike. Their opposition is rooted in the belief that the submission infringes on showrunners’ decision-making authority and could result in unnecessary hiring practices.

A prominent showrunner stated, “None of us requested this change; there’s no logic to it.”

Another writer highlighted, “Showrunners who require a staff should have the freedom to assemble one, but imposing this on those who prefer to operate without a staff is unnecessary.”

The WGA initially proposed a minimum of six to 12 writers for TV shows, adjusting based on the number of episodes in a season. Despite reducing the demand by one writer, the guild maintains its stance on the essential structure of this requirement.

Dissenting showrunners argue against forced hiring of unnecessary writers, likening it to “featherbedding,” a practice that mandates employers to hire surplus workers. They say that this could result in the creation of redundant roles that detract from creative productivity.
