Marvel Faces Copyright Infringement Suit Over Werewolf by Night Artwork

Amid a string of controversies, Marvel Studios, already under scrutiny for diversity and working conditions, is now in a legal tussle. Digital artist Darius Alas is suing for copyright infringement. He claims the studio unlawfully used his original wolf drawing in the Werewolf by Night TV special, released in 2022.

Accusations of Artwork Misuse

Alas asserts that Marvel reproduced his artwork initially intended for the hardcore band, Born From Pain. Despite his attempts to communicate with Marvel and its parent company Disney, he received no satisfactory response. As a result, Alas saw no other option but to take legal action.

Evidence Against Marvel

The lawsuit filed in the Southern District of New York alleges that Marvel illicitly utilized the digital creator’s artwork. According to the court records dated March 19, 2024, Alas has showcased and sold his designs on various platforms. Consequently, the artist claims that Marvel and Disney knowingly copied his artwork to secure financial benefit. The court files suggest a stark resemblance between Alas’s work and Marvel’s piece, with significant similarities in components, composition, colors, arrangement, and overall appearance.

Shortly after the Werewolf by Night release, Alas issued a cease-and-desist letter to Marvel and Disney on September 5, 2023. However, their inadequate response led to the legal proceedings.

Reparations Being Sought

Alas’s lawsuit demands several remedies. He seeks injunctions against further copyright violations, recompense for profits procured through the infringement, damages for economic losses, and coverage of legal fees. Marvel has yet to respond publicly to these allegations.

Ongoing Issues at Marvel Studios

This charge comes at a time when Marvel Studios is grappling with a multitude of complaints. Actor Anthony Mackie, known for his role as The Falcon in the Marvel Cinematic Universe (MCU), has criticized the studio for its lack of diversity measures.

Mackie pointed out that while a majority of the crew members on most Marvel productions are white, the Black Panther shoots were predominantly black. He underscored the irony, labelling it as a form of racism.

VFX Artists Express Workplace Discontent

Apart from the racism controversy sparked by Mackie, Marvel’s VFX artists have also cited displeasure with their work conditions. They are particularly disgruntled about long working hours, pay gaps, and insufficient protection rights. Following their complaints, around 50 artists initiated a unionization process under the International Alliance of Theatrical Stage Employees (IATSE) in 2023.

As Marvel picks up the pieces from these controversies, fans can currently stream Werewolf by Night on Disney+. With an outstanding copyright infringement case, re-evaluation of diversity policy, and amendments to workplace conditions, the studio certainly has its hands full. Only time will tell how these issues resolve and influence the studio’s future projects.
